The Elizabeth Township Board of Commissioners has given the green light to EQT’s Heracles natural gas project despite objections from residents concerned about its proximity to Elizabeth Forward High School and potential health implications. The unanimous vote on Monday approved two conditional use permits for the six-well project which has been the subject of a three-year legal battle between environmental group Protect Elizabeth Township (PET) and the company.

The decision comes after a lengthy process that included a three-hour conditional use hearing in July where residents expressed worries about the project’s environmental and health impacts. The board’s approval includes several stipulations aimed at ensuring the site’s safety and addressing community concerns.

The Approval Process and Community Response

During the Monday evening commission meeting seven residents spoke out against the project, citing concerns over air quality, climate impact, and water withdrawals. Catherine Anderson an Elizabeth Township resident, expressed her apprehension about the development of gas infrastructure in the township, stating, “I’m concerned about the development of gas infrastructure in our township. I don’t believe it serves us very well. Pulling gas out of the ground and burning it has consequences for air quality, our environment and climate, and water withdrawals.”

Russell Verbanec was the sole resident to speak in favor of the project, highlighting lower natural gas prices and other financial benefits for township residents. He also expressed confidence in EQT’s ability to conduct operations safely, asserting that “EQT can conduct their operations with no negative impacts to the health and safety of the public.”

Commission President Joshua Walls read a statement on behalf of the board, indicating that the township had been approached for a potential data center development. The board emphasized the need to fully understand the proposed project and its potential impacts before forming any conclusions. A public information session on the data center project is expected to be scheduled in the future.

Conditions of the Approval

The approval of the conditional use permits came with several stipulations to address safety concerns and community impact. Township Solicitor Matt Racunas outlined the conditions, which include:

  • Emergency Preparedness Fund EQT is required to contribute to a 10-year, township-controlled fund for emergency preparedness, particularly due to the site’s proximity to the high school. This fund can be used to purchase and update fire equipment for the township’s fire departments.
  • Attorney and Engineering Fees EQT must cover the township’s attorney and engineering fees associated with the conditional use application and hearing process.
  • Security Measures The company is required to install three security cameras at the site and provide the township with access to air monitoring reports.
  • Roadway Repair EQT is responsible for repairing or resurfacing any township-owned roadways damaged by the company’s operations.

These conditions aim to mitigate potential risks and ensure that the project operates safely and responsibly within the community.

The Legal Battle and Future Implications

The Heracles project has been embroiled in litigation since its inception. PET filed a lawsuit against the township shortly after the initial conditional use permit was approved in 2023. A state appellate court subsequently threw out that permit, ruling that the township’s approval violated its own zoning regulations. EQT revised its plan by subdividing the property into separate lots, which the township approved in September.

PET is currently challenging the subdivision in court, arguing that the township approved it despite numerous errors in the town’s zoning ordinances. Additionally, PET has filed a separate lawsuit to halt production at the site entirely, claiming that the site is unauthorized to produce gas without an existing permit. Both lawsuits are currently pending, indicating that the legal battle is far from over.

Despite the ongoing litigation, EQT has been producing natural gas at the site since April 2024. According to EQT legal filings, the site has produced just over 35.5 billion cubic feet of natural gas from April 2024 to April 2026. This production highlights the project’s significance and the stakes involved in the legal and community debates surrounding it.

The final approval of the Heracles project marks a significant milestone in the ongoing dialogue between the community, the township, and EQT. As the legal battle continues, the project’s future remains uncertain, with potential implications for the environment, public health, and the township’s development.
